Panasonic Philippines Electronic Bidding Application

1. Introduction

These Terms and Conditions govern the use of the Panasonic Philippines Electronic Bidding Application (“Application”) by suppliers, contractors, consultants, and other participants. By accessing or using the Application, users agree to comply with these terms, which are aligned with applicable Philippine laws including:

  • Republic Act No. 12009 – New Government Procurement Act.
  • Republic Act No. 9184 – Government Procurement Reform Act and its 2016 Revised IRR.
  • Republic Act No. 10173 – Data Privacy Act of 2012
  • Republic Act No. 8792 – Electronic Commerce Act of 2000
  • Relevant guidelines from the Government Procurement Policy Board (GPPB) and PhilGEPS.

2. Scope of Application

This Application supports electronic procurement for both private and public sector engagements, including:

  • Posting of bid opportunities and documents
  • Submission, receipt, and opening of bids
  • Bid evaluation and awarding
  • Contract implementation and monitoring
  • Electronic payments and audit trail generation

3. User Eligibility and Registration

Users must register with valid credentials and agree to Panasonic’s procurement policies. Public sector bidders must comply with PhilGEPS registration requirements. All submitted documents must be accurate and authentic, subject to post-qualification validation.

4. Legal Compliance

Users agree to comply with all applicable laws, including anti-corruption, fair competition, and data protection regulations. Panasonic reserves the right to suspend or disqualify users for violations of these terms or applicable laws.

5. Intellectual Property

All content, trademarks, and materials within the Application are the property of Panasonic. Unauthorized reproduction, distribution, or commercial use is strictly prohibited.

6. Data Privacy and Security

Panasonic implements robust data protection measures in accordance with the Data Privacy Act of 2012. Personal and bid-related data are collected, processed, and stored securely. Users consent to the collection and use of their data as outlined in Panasonic’s Privacy Policy Statement.

7. Bid Submission and Evaluation

Electronic bids must be submitted within the prescribed deadlines. Bids shall consist of technical and financial components, and may be modified prior to submission. Late or incomplete bids will not be accepted. Bid opening shall be conducted electronically and documented for transparency.

8. Confidentiality and Communications

All communications through the Application are considered non-confidential unless otherwise stated. Panasonic reserves the right to monitor and retain records of transactions for compliance and audit purposes.

9. Limitation of Liability

Panasonic shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Application, including system outages, data loss, or unauthorized access.

10. Amendments and Termination

Panasonic may revise these Terms and Conditions at any time. Continued use of the Application constitutes acceptance of the updated terms. Panasonic may suspend or terminate access for violations or system maintenance.

11. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall be resolved exclusively by the courts of competent jurisdiction in the Philippines.
